Anne Arundel County Board of Appeals met Oct. 25.

Present: Mr. Dove, Acting Chairman, Mr. Devlin, Mr. Hare, and Ms. Baker Blackshear, Members.
Amanda E. Schmidt, Counsel to the Board.
Absent: Mr. Forgo, Chairman, Mr. Middlebrooks, Vice Chairman, and Mr. Breitenbach, Member.
The hearing was convened at 5:30 p.m.
The Board convened to continue testimony on case no. BA 36-17S, Kimberly & Darren Greco.
Mr. Daniel Mellin, Petitioners’ attorney, made a motion for mistrial and a request for new hearings. Ms. Barbara Palmer, Protestants’ attorney, and Ms. Christine Neiderer, County attorney, argued against the motion.
Mr. Hare made a motion, seconded by Mr. Dove, to grant Mr. Mellin’s motion and request. The motion failed one (1) to three (3), with Mr. Dove, Mr. Devlin and Ms. Blackshear opposed.
Ms. Blackshear made a motion, seconded by Mr. Devlin, to deny Mr. Mellin’s motion and request. The motion carried three (3) to one (1), with Mr. Hare opposed.
Mr. Mellin and Ms. Palmer submitted written closing arguments. Ms. Neiderer will submit her closing argument on October 29, 2018, and Mr. Mellin will submit his final closing argument on October 31, 2018.
The hearing was adjourned at 7:08 p.m.
