City of Gaithersburg Board of Appeals met Aug. 8.

1. CALL TO ORDER

The Regular Session of the Board of Appeals was called to order at 7:30 PM with Chair Carol Rieg presiding.

2. APPROVAL OF MINUTES

A. Regular Session held June 13, 2018

A motion was made to approve the minutes of the June 13, 2018 session.

3. PUBLIC HEARINGS

A. BOA-7981-2018: Variance for a screened porch at 13 Bradenton Court in the R-90C

(Medium Density Residential Cluster) Zone.

Planner Forbes introduced the application and located the property on an aerial photograph

Applicant and homeowner Jay Maxwell stated that he was requesting a variance in order to enclose an existing deck into a screened porch. The porch is desired to protect the residents from the sun and mosquitos. Mr. Maxwell described his property, noting its peculiar shape. He noted that the short side yard on one side of the property required the house to be sited in such a way that the rear part of the house comes close to the required setback. Only a small triangular part of the existing deck falls within the required setback and without the variance he would need to leave a portion of the existing deck open.

In response to questions from the Board, Mr. Maxwell stated that none of his neighbors would be able to see the screened porch from their yards and that his rear yard is very private.

The Board discussed the request and agreed that the property lines are peculiar and that the granting of the variance would not constitute a hardship for any of the neighbors.

Motion was made to approve Variance BOA-7981-2018 - eight foot variance of the required twenty foot setback of an outside boundary line at 13 Bradenton Court in the R90(C) (Medium

Density Residential) Zone, based on the findings and conclusions outlined in the draft resolution and adopt resolution BOA-7981-2018.

RESULT: PASSED [UNANIMOUS]
